This case was
first filed separately in the U.S. District Court for the Northern District of Florida
with Henry McMillan and others filing suit against the Escambia County, Florida, Board of
Commissioners, the School District of Escambia County, the School Board of Escambia
County, and Escambia County superintendent of elections. The second suit was filed by
Elmer Jenkins and others against the City of Pensacola, the Pensacola City Council, and
elections supervisor. The two cases were filed March 18, 1977, and consolidated April 17,
1979.
Both cases called for redistricting as
it related to the election of members of the Pensacola City Council and the Escambia
County Board of Education. All members of both governing bodies were elected at-large, and
the plaintiffs alleged that this diluted black votes and limited chances for blacks to be
elected. The district court agreed in December 1978 that the citys districting was
unconstitutional and ordered a change. The city presented a new plan in 1979 that called
for seven single-member districts, plus three at-large council members. The court approved
the plan, but the plaintiffs appealed to the U.S. Supreme Court, alleging that the plan
was still unconstitutional because of the three at-large council seats. The sides agreed
to drop the case and allow the 7-3 compromise to go into effect in the 1983 elections.
There is no definitive answer in the files as to the outcome of the school board
complaint.
