Alabama Living Donor Protection Act
An employee, who has completed one year of employment, may be granted living donor leave with pay for donating an organ or bone marrow, upon fulfillment of the following conditions:
- The employee must complete and submit a Living Donor Request Form to their immediate supervisor.
- The Living Donor request form must be accompanied by a written verification statement from the physician who will be performing the medical procedure.
- The Living Donor request form must be signed by the employee’s supervisor and submitted to Human Resources via email at employeebenefitshr@southalabama.edu or via fax at 251-460-7483.
- Upon receipt of the request form, Human Resources will process it and issue an approval letter to the employee’s home address.
- Regarding pay, based on the type of leave donation, the employee will submit the paid leave by using pay code OAL – Other Administrative Leave for the applicable number of eligible leave days; along with a comment stating: Using for living donor leave. If the employee is unable to complete their timesheet their immediate supervisor will follow the same procedure.
Paid leave may be granted for no more than 30 days for an organ donation and 7 days for a bone marrow transplant. The living donor leave will be a separate leave category and will not apply to the employee’s accrued sick leave, vacation leave or paid time off (PTO).
